By accessing or using Superrshots ("the Service"), you acknowledge that you have read, understood, and agree to be bound by the following Terms of Service. If you do not agree with these terms, please do not use the Service.

 

License and Usage Rights

 

Upon successful generation of headshots through the Superrshots platform, you are granted a non-exclusive, non-transferable, revocable license to use the resulting images for personal and commercial purposes. 

 

Prohibited Conduct

 

Users are strictly prohibited from uploading content that is illegal, obscene, pornographic, defamatory, infringing, or otherwise inappropriate. You may not attempt to reverse engineer, decompile, disassemble, or derive source code or underlying structure from the Service or any part thereof. Any unauthorised use or redistribution of the Service may result in the termination of your access.

 

User Account and Access

 

Access to the Service is facilitated via email-based authentication. Sharing of access links or login credentials with third parties is strictly prohibited. You are responsible for maintaining the confidentiality and security of your login details.

 

Ownership of Content

 

You retain full ownership of the photographs you upload to Superrshots. We do not claim any rights over your original content, and we will not use your uploaded images in any marketing or promotional material without your explicit, written consent.

 

Disclaimer of Warranties
 

The Service and all content, tools, and output provided through Superrshots are made available on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the Service will meet your expectations or be uninterrupted, error-free, or secure.

 

Limitation of Liability

 

To the maximum extent permitted by applicable law, Superrshots, its affiliates, and its employees shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of data, loss of business, or service interruptions, arising out of or related to your use of the Service.

Superrshots is not liable for any perceived inaccuracies, bias, likeness issues, or offensive output generated by the underlying AI model.

 

Governing Law and Dispute Resolution

 

We’re based in India, and these Terms are governed by Indian law. Specifically, they’re governed by and interpreted in accordance with the laws of India, without regard to conflicts of law rules.

 

If a dispute arises between you and Superrshots, we hope to resolve it quickly and fairly through open communication. If needed, both parties agree to first try to resolve the issue informally within 30 days.

 

If that doesn’t work, any legal disputes will be handled through binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Chennai, Tamil Nadu, India, in English. Each party will bear its own legal costs, unless otherwise determined by the arbitrator.

 

By using Superrshots, you agree that any legal action or claim relating to these Terms or the Service will fall under the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India. However, we reserve the right to seek injunctive relief in other jurisdictions if necessary to protect our rights.

 

If you're a consumer based in the European Union, this choice of law and jurisdiction does not override any mandatory protections you are entitled to under your local laws - especially your rights under EU consumer protection or data protection laws like the GDPR.

 

Modifications to the Terms

 

We reserve the right to modify or update these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the revised Terms. We encourage users to review this page periodically.

 

Termination and Suspension

 

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, if we believe you have violated these Terms, engaged in unlawful activity, or otherwise misused the platform.

You agree to indemnify and hold harmless Superrshots, its affiliates, and its employees from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of your violation of these Terms or misuse of the Service.

Data Retention and Privacy (DPDP Act Compliance)

 

We take your privacy seriously and follow the Digital Personal Data Protection (DPDP) Act, 2023 of India to protect your personal data.

 

How long we keep your data:

 

Photos you upload and generated portraits are kept for up to 7 days after your headshots are delivered. After that, they are deleted from our system.

 

Why we collect your data:

 

We only use your data to create your headshots. We don’t use it for advertising, marketing, or AI training — and we never share it with third parties without your clear permission.
